 By accessing and using U4RIA App, you agree to comply with and be bound by these terms and conditions.

 

2. Agreement Use of the App:

 2.1. Service Access Eligibility

Age Requirements: You can access our Services if you're at least 18 years old and if there's no legal restriction against you using such services in your jurisdiction. For any purchases through our Services (refer to the "Purchases" section for details), you need to be a minimum of 18 years old and be legally eligible to enter into contracts.

If you are under the age of 18, you may access our Services only with the consent and supervision of a parent or legal guardian. By using our Services, you represent and warrant that you have received this consent. Parents and legal guardians should monitor their children's use of our Services and ensure their child's compliance with our terms.

 

2.2. Account Setup and Your Details

To access specific features of our Services, you'll need to establish an account (“Account”). This can be done either through our App or use our site when applicable and ready.

When setting up your Account, it's vital that you furnish us with precise, comprehensive, and current details. Ensure that this information remains accurate and updated as required. Should you fail to maintain this standard, we may have to suspend or terminate your Account.

Never share your Account password with anyone, and immediately inform us if you suspect any unauthorized activity on your Account. Remember, you're accountable for all actions taken under your Account, even if you weren't aware of them.

 

3. Personalized Content:

 3.1. Through U4RiA's services, individuals have the opportunity to choose from an array of options, crafting personalized relaxation and self-improvement sessions. Additionally, you can access premium features within the services by opting for the paid functionality, or make purchases of available items ("Products") as elaborated further in the "Purchases" section below.

 

It is essential to comprehend and concur that the U4RiA Services, Products, and any other insights you acquire are not meant, devised, or implied for diagnosing, preventing, or treating any condition or ailment, determining your health status, or serving as a substitute for professional medical attention. Not all activities delineated in the Services or Products are universally suitable. Refrain from employing the Services while engaged in activities such as driving, operating heavy machinery, or tasks that necessitate focus and concentration. Recognize and consent that your utilization of the Services is entirely your responsibility as this app is designed for entertainment purposes.

 

3.2. You acknowledge that the AI-generated content is based on algorithms and data inputs, and the App does not guarantee specific outcomes or effects, but just an experience.

 

4. Community Section:

4.1. You may not post content that is defamatory, fraudulent, obscene, threatening, invasive of another person’s privacy rights or that is otherwise unlawful. You may not post content that infringes on the intellectual property rights of any other person or entity. The U4ria app has the right to terminate the account in any occurrences as how we see fit. We reserve the right to terminate your access to the Services at our sole discretion, at any time, without providing notice

5. Privacy and Data Collection:

 5.1. The App collects certain personal and usage data. By using the App, you consent to the collection, processing, and storage of this data as outlined in the Privacy Policy. 

 

6. Intellectual Property:

 6.1. The content provided by the App, including text, graphics, images, and other materials, is protected by copyright and other intellectual property laws.

 

6.2. You may not reproduce, modify, distribute, or otherwise use any content from the App without obtaining proper authorization.

  

7. Limitation of Liability:

7.1. U4Ria and its affiliates will not be liable for any indirect, special, or consequential damages arising from or related to the use or inability to use the Services, Products, or Content, regardless of the cause or legal theory. This includes, but isn't limited to, profit losses, data, or goodwill, service interruptions, computer or system damage, or the cost of alternative Services or Products, regardless of the claim's basis (warranty, contract, tort, etc.) This applies even if U4Ria has been advised of potential damages. In any case, U4Ria’s maximum liability will not exceed the amount you've paid to U4Ria for the Services or Products, or $75 if no payment was made. Certain jurisdictions may not allow some limitations, and they may not apply to you."

 

8. Termination:

8.1. We reserve the right to terminate your access to the Services at our sole discretion, at any time, without providing notice. If you wish to cancel your Account, please reach out to us directly.  through email. Should you have acquired a Subscription via an App Provider, it's essential to also cancel your Subscription through them. In the event of termination, discontinuation, or cancellation of the Services or your Account, essential provisions of these Terms, such as ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions, will be non-effective.

 

9. Changes to Terms or Services:

 

9.1. The App reserves the right to modify, amend, or update these terms and conditions at any time. Any changes will be notified to users through a prominent notice on the App.

 

9.2. We reserve the right to update our Terms at our discretion. When changes occur, we'll inform you either by updating them on our Site or through other methods of communication. Please review any changes carefully. Your continued use of the Services post-update signifies your acceptance of the revised Terms. If you disagree with the changes, you should stop using our Services. As our Services continuously evolve, we might modify or cease parts of the Services, without prior notice, at our discretion."

 

10. Governing Law:

 10.1. These terms and conditions are governed by and construed in accordance with the laws of Ontario Canada. Any disputes arising from the use of the App shall be subject to the exclusive jurisdiction of the courts in Ontario, Canada

 

11. Purchasing and Fees:

 11.1. U4RiA offers enhanced features through subscriptions, available on a monthly, yearly. These subscriptions provide unique benefits, detailed in the services. When you buy a Subscription or Product ("Transaction"), we may ask for additional Transaction-related details like your credit card number, expiration, and addresses for billing and delivery ("Payment Information"). By providing this, you confirm your right to use the payment method. Charges for Transactions are presented prior to order completion. Initiating a Transaction allows us to share your Payment Information with third-party providers for processing. You agree: (a) to pay fees and taxes; (b) U4RiA may charge your payment method for validation and payment; and (c) you're responsible for extra charges and taxes from providers. After payment, you'll get a confirmation email. Remember, orders are confirmed by U4RiA. Payments are non-refundable, unless specified in Terms.

 

For charge concerns, discuss with us before disputing, avoiding unwarranted cancellations. U4RiA reserves the right to reject orders due to various factors, and may verify your identity. Orders not processed will incur no charges or will be refunded.

 

12. Subscriptions Renew Automatically Unless Canceled & Cancellation Procedure:

 

When you make a purchase: (i) For yearly transactions, you're charged at the point of sale. (ii) For monthly subscriptions, you're charged at the start of the subscription period. Since these subscriptions auto-renew for periods identical to the original term, you'll be charged at every renewal unless you cancel. To prevent charges for the next cycle, ensure you cancel your subscription before its renewal.

 

If you cancel your subscription and opt for a free subscription, all your saved content and personal information will be permanently deleted 30 days after the cancellation.

 

Should you have acquired your subscription through our website, you can halt its renewal anytime by reaching out to us through email. If your subscription was made via an app provider, address your cancellation with them directly. Kindly note that there won't be any refunds for fees incurred in your current subscription duration. However, you'll keep availing the services until the ongoing subscription period concludes.

 

13.Upgrade and Usage Policy

 13.1. Plan Upgrade:

If you choose to upgrade your current plan, the new plan will take effect immediately following the expiration of your current plan. This ensures a seamless transition in services, allowing you to benefit from the upgraded features without disruption.

 

13.2. Monthly AI Generation Quota:

Each plan includes a specific quota for AI-generated content per month. It is important to note that this quota is set on a monthly basis and does not carry over to the subsequent month. Unused AI generation capacity from one month will not be added to the next month's quota. We encourage you to utilize your monthly quota to make the most of your plan's benefits.

 

 

14. Modifications to Subscription Pricing:

U4Ria retains the authority to modify its subscription pricing terms at any given time. We will ensure to inform you prior to these changes taking effect. Any alterations in pricing will not be retroactive and will be applicable only for subscription renewals after we've conveyed these updated terms to you. If you disagree with the revised pricing conditions, you have the option not to continue your subscription as detailed in the section “Subscriptions Renew Automatically Unless Canceled & Cancellation Procedure.

 

15. Content Ownership: 

U4Ria does not assert ownership over any User Content. Nothing in these Terms will be interpreted to limit any rights you possess to use and capitalize on your User Content. With that in mind, U4Ria and its licensors solely and exclusively hold all rights, titles, and interests in and to the Services and Content, inclusive of all related intellectual property rights. You recognize that the Services and Content are safeguarded by copyright, trademark, and other legislations of Canada and abroad. You commit to refraining from modifying, erasing, or obscuring any copyright, trademark, service mark, or other proprietary rights notifications that are integrated within or accompany the Services or Content.

 

16. Rights in User Content Granted by You:

16.1 By sharing any User Content via the Services, you hereby grant U4RIA a non-exclusive, transferable, sublicensable, global, royalty-free license to utilize, replicate, alter, generate derivative works from, distribute, publicly showcase, publicly perform, and disseminate your User Content. This is in relation to operating and offering the Services and Content to both you and other users.

  

17. Prohibitions:

While using our Services, you agree to refrain from:

1. Sharing Content that:
• Violates third-party intellectual property or privacy rights.
• Encourages behavior contrary to applicable laws or could lead to civil liability.
• Is deceptive, defamatory, offensive, or promotes discrimination or violence.
• Encourages illegal or harmful actions or substances.
2. Misusing U4RIA’s proprietary elements, including its name, trademarks, or designs without explicit written consent.
3. Accessing or tampering with non-public areas of our Services or systems, or trying to bypass our security measures.
4. Using tools or software other than general web browsers to access, search, or download content from our Services.
5. Sending unsolicited materials or communications, or using U4RIA 's logo, URL, or product name without authorization.
6. Exploiting the Services for unauthorized commercial gain or deceiving/impersonating any entity or individual.
7. Trying to reverse engineer any software related to the Services or disrupting users' access.
8. Collecting personal data from other users without consent or violating any laws or regulations.

Although not obliged, we may monitor Service usage and Content to ensure adherence to these Terms. We can, at our discretion, remove content or restrict access. We might also collaborate with authorities in case of violations or illegal activities.

 

18. Connections to Third-Party Websites or Resources:

 Within the Services and App, you might come across connections to websites or resources operated by third parties. These connections are supplied purely for your convenience, and we bear no responsibility for the content, products, or services featured on those websites or resources, nor for the links presented on such websites. It is your acknowledgment that you bear exclusive responsibility for and accept all potential risks associated with your utilization of any third-party websites or resources. 

 

19. Warranty Disclaimer: 

The Services, Products, and Content are provided in their current state without any warranties. We explicitly disavow all warranties of merchantability, suitability for a specific purpose, peaceful use, non-infringement, and any warranties originating from customary business practices or trade usage.

We do not ensure that the Services or Products will satisfy your requirements or remain continuously available, secure, or free from defects. Furthermore, we do not guarantee the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any Content.

20. Indemnity:

You agree to indemnify and protect U4RIA, along with its officers, directors, employees, and agents, from any claims, disputes, demands, liabilities, damages, losses, as well as associated costs and expenses. This includes, but is not limited to, reasonable legal and accounting fees. These claims must arise either from your use of the Services or Content or from your violation of these Terms in any manner.

21. Additional Terms for App Store Apps:

If you got the App from the Apple Store, you agree to use it on an Apple device with iOS, following the Apple Store's "Usage Rules."

If you got the App from another provider:

• These Terms apply to you and U4RIA not the App Provider. U4RIA is solely responsible for the App.
• The App Provider isn't obligated to provide maintenance or support for the App.
• If the App doesn't meet its warranty, contact the App Provider for a refund (if applicable), but they have no other warranty obligations. Any other issues are U4RIA 's responsibility.
• The App Provider isn't responsible for any claims related to the App, including product liability, legal requirements, or consumer protection claims.
• If the App infringes someone's intellectual property rights, U4RIA  is responsible for addressing it.
• The App Provider and its subsidiaries can enforce these Terms as third-party beneficiaries regarding your App license.
• You must follow any third-party terms of service when using the App.
• You agree to comply with export laws and regulations, ensuring the App isn't used in violation of those laws. You also confirm you're not in a Canadian embargoed country and not on any Canadian Government prohibited or restricted parties list.
